Job Description

The Corporate Counsel for Pricing and Access will primarily serve as counsel for specialty pharmacy contracting and other healthcare compliance issues related to access and reimbursement. In this role, the Pricing and Access counsel will provide legal guidance and counsel to business and cross-functional teams in a matrixed corporate environment that requires an enterprise mindset and effective collaboration with internal legal subject-matter experts and key cross-functional stakeholders.

ROLE RESPONSIBILITIES

  • Assisting in the structuring of Pfizer’s contractual relationships with specialty pharmacy providers in master services agreements (MSAs) and statements of work (SOWs).
  • Lead review and response in continuing negotiations with specialty pharmacies on all MSAs and on specific account SOWs.
  • Reviewing proposed customer engagement programs to support appropriate specialty pharmaceutical therapy adherence with attention to fair market value assessment, anti-kickback statute compliance, and safe harbor exceptions.
  • Drafting statements of work to capture specific core and supplemental services in specialty pharmacy arrangements.
  • Acting as lead counsel for managing contracting and engagement with the Drug Safety Unit for Customer Engagement Program implementation to support appropriate reporting of adverse events by specialty pharmacy personnel who are performing services for and on behalf of Pfizer.
  • Legal lead for SUNSHINE and SUPPORT Act reporting responsibilities including review and execution of annual report and attestation submission, coordination with internal and external counsel on legal interpretation, development of Pfizer policy, industry benchmarking, and developing enforcement landscape.
  • Draft and negotiate contracts with third-party vendors responsible for implementing Pfizer’s free drug and reimbursement support programs
  • Advise internal teams regarding design and operation of reimbursement support programs, considering fraud and abuse laws, state law considerations, and other legal framework impacting pharmaceutical manufacturers
  • Analyzing and drafting discount and rebate agreements
  • Understand the strategic and tactical objectives of the commercial, medical, development, and community/patient engagement teams and develop creative and thoughtful solutions to key initiatives, taking into account current legal and regulatory landscapes, Pfizer policies and procedures and the current and future needs of Pfizer;
  • Work constructively and collaboratively with other members of Pfizer’s Legal Division, legal staff, business colleagues and compliance professionals.
  • Demonstrate strong organizational, interpersonal, and communication skills as well as sound judgment with a high level of professionalism and minimal supervision. Must possess leadership skills and be detail-oriented, a quick learner, and able to work effectively in a highly matrixed organization.

Ability and willingness to:

  • Gain deep understanding of business strategies and actively counsel on business and legal approaches and opportunities
  • Build networks throughout the Pfizer Legal Division and the company, and receive input from and collaborate with attorneys and other colleagues providing platform services

  • Excellent drafting and negotiation skills with an eye for detail combined with pragmatism/sound judgment
  • Excellent communication skills to convey complex legal issues to clients in a clear and concise manner

BASIC QUALIFICATIONS

 The successful candidate must have the following qualifications, skills and attributes:

  • Strong academic background, Bachelor’s Degree and Juris Doctorate or equivalent law degree
  • 7+ years legal and/or compliance in the pharmaceutical or biotech industry, including experience in regulatory law and commercial/medical-related matters.
  • Strong Leadership Skills and the ability to support Team Leaders within the organization.
  • Demonstrated ability to grasp statutory and regulatory concepts quickly, and to proactively identify and analyze potential legal issues and provide thoughtful and creative business-focused legal advice and solutions.
  • Proven capacity to cultivate strong client relationships and successfully influence leadership in a fast-paced, innovative business climate.
  • A thorough understanding of regulatory and legal frameworks governing the sales and marketing of approved medicines, and regulatory framework for investigational medicines.
  • Candidate demonstrates a breadth of diverse leadership experiences and capabilities including: the ability to influence and collaborate with peers, develop and coach others, oversee and guide the work of other colleagues to achieve meaningful outcomes and create business impact.

NON-STANDARD WORK SCHEDULE, TRAVEL OR ENVIRONMENT REQUIREMENTS

  • Minimal travel up to 10% for off-site meetings.
