The City of Rockville is seeking an experienced attorney for its in-house City Attorney's Office. This position may be filled at the Assistant City Attorney level or Senior Assistant City Attorney level, depending on qualifications. Applicants must be a member of the Maryland State Bar and have experience in providing legal counsel and representation on a variety of matters with minimal supervision. Experience in Maryland local government law is required. The position entails providing legal counsel related to all aspects of municipal law including Open Meetings, Legislation, Transactional Matters, Personnel, Land Use, Public Information, Code Enforcement and Litigation. The position requires the ability to attend regular evening and weekend meetings and to handle a heavy workload including the ability to balance multiple priorities. The successful applicant will be responsible for providing legal advice to staff from all departments in the City; providing advice to and attending various boards and commissions meetings; preparing and reviewing documents including easements, leases, and other agreements; preparation and/or review of legislation; representing the City in administrative appeals and litigation before State and Federal Courts; and analyzing and recommending solutions to complex and unique legal problems. The successful applicant must be able to take the initiative in identifying and resolving issues and demonstrate the ability to work independently in performing his/her duties in a fast-paced work environment. The successful candidate must also be able to work with and manage outside counsel in a fiscally responsible manner.
Essential Job Functions
- Conducts legal research and analysis of legal issues; interprets and applies statutes, ordinances, case law and other legal authority in the preparation of opinions (both written and oral), memoranda, and court pleadings.
- Reviews the legality and/or sufficiency of contracts, bonds, bids, leases, insurance, deeds, easements, and other documents that have legal, financial and/or policy implications; analyzes documents for legal consequences; approves documents for execution by the City; represents the City's interest in various contract negotiations.
- Drafts and/or reviews contracts, leases, deeds, easements, covenants, MOUs and other legal documents before they may be executed by the City Manager.
- Advises on transactional matters including real property (conveyance of land, easements, covenants, lending transactions, etc.) and contracts (review of contracts and review of procurement documents).
- Advises the City officials and staff regarding legal issues arising out of proposed legislation; drafts and reviews legislative bills, resolutions, ordinances, and regulations; analyzes documents for legal and policy consequences; makes recommendations regarding legal issues affecting the City.
- Provides legal advice to the City Manager, department heads, and other City staff, including the review and advice on major proposed actions, advice on specialized areas of the law, and legal review of written material.
- Represents the City in lawsuits before Federal and State courts and in administrative hearings, including enforcement actions; prosecutes municipal infractions; represents the City in actions for judicial review of administrative decisions.
- Prepares court pleadings, contracts, ordinances, resolutions, deeds, easements, leases, and other legal documents.
- Investigates complaints and claims by or against the City.
- Serves as counsel to the City's boards and commissions; attends meetings of the boards and commissions and advises on legal matters; represents boards and commissions in Court on petitions for judicial review.
- Performs other duties as assigned.
Education and Experience:
Graduation from an accredited school of law and at least (7) years of experience as a practicing attorney, including experience involving Maryland local government law. Experience in Maryland local government law, open meetings, legislation, transactional matters, personnel, land use, public information, code enforcement and litigation is required.
Membership in the Maryland State Bar.

- Skill in drafting, negotiating, and revising various types of agreements.
- Ability to perform legal review and research; assimilate and analyze difficult facts, issues, and problems; determine alternative courses of legal action; and render a legal opinion and recommendation expeditiously.
- Skill in preparing and presenting oral and/or written legal opinions and the ability to explain and defend an opinion and legal position, which would include, but not be limited to, providing a comprehensive explanation of legal concepts, positions, and/or policies, in judicial as well as administrative settings.
- Ability to devise and draft effective legislation and other legal documents including, but not limited to, letters, contracts, briefs, motions and other court papers.
- Ability to establish and maintain effective working relationships with all level of employees.
- Ability to work with and manage outside counsel in a fiscally responsible manner.
- Ability to attend meetings and perform work assignments at times other than normal business hours.
