Job Summary

The Senior Attorney and Manager of Enterprise Risk Management (ERM) provides legal advice and support to ACGME staff members, supervises the work of outside counsel, and leads the development of strong ERM capabilities at the ACGME. This role requires working in collaboration with senior ACGME leaders, peers, and frontline staff members as a trusted advisor and subject matter expert on legal risk, liability exposures, and risk management.

The successful candidate will have a solid understanding of the legal issues faced by non-profit organizations, including exposure to liability and risk issues in an organization working in the health care field or providing accreditation services.

The successful candidate will draft, negotiate, and manage the execution and tracking of ACGME contracts for domestic and international transactions; review and revise policies and procedures to strengthen and support effective operations; perform legal and other research; prepare and deliver memoranda and reports containing thoughtful analysis and recommendations; lead and facilitate meetings of the ACGME’s Risk Champion Group; collaborate with staff members and consultants on the completion of periodic risk assessments for the organization; design and deliver high-level risk reports to the exectuive team; and support the design of thoughtful risk reports to the ACGME’s governing teams.

Primary Duties and Responsibilities

  • Draft, review, and negotiate ACGME contracts including, but not limited to, confidentiality, consulting, licensing, and service agreements.
  • Draft and review business agreements with international health care and graduate medical education institutions.
  • Negotiate and draft data sharing agreements with Sponsoring Institutions, certifying boards, specialty societies and colleges, and resident and fellow physicians.
  • Oversee the efficient tracking of contract obligations and commitments.
  • Work in partnership with other ACGME leaders and external consultants in completing periodic organization-wide and issue- or function-specific risk assessments.
  • Design and deliver risk reports that illustrate risk management aspirations, progress, and areas of focus, as well as top-risk concerns.
  • Build support for an enterprise approach to risk assessment, risk management, and the continued evolution of strong ERM capabilities.
  • Design and deliver periodic staff training and briefings on risk management, contracting, compliance, and other relevant topics.
  • Advise, support, and collaborate with ACGME leaders to ensure timely responses to crisis events and emergencies.
  • Review external and internal communications and ensure adherence to relevant laws and regulations.
  • Develop expertise on accreditation matters, resident/fellow affairs, and graduate medical education.
  • Perform legal research on laws, regulations, and legislation impacting the ACGME, and draft memoranda summarizing findings and recommendations.
  • Address issues in a variety of other areas as they arise, including education policy development and enforcement, human resources/employment, tax, insurance, etc.
  • Work with and supervise outside counsel retained by the ACGME for operational matters, including litigation.
  • Draft and revise policies and procedures as assigned.
  • Other duties as assigned.

Education, Knowledge, Skills, and Abilities

Required:

  • Juris Doctor degree; graduate of an ABA-approved law school; licensed in Illinois.
  • 10+ years of relevant experience, including service as in-house or external counsel to non-profit organizations, heath care, or graduate medical education entities.
  • Excellent interpersonal skills and the ability to communicate and interact effectively with staff members and leaders from the frontline to the C-suite.
  • An open, flexible approach, with a positive attitude and a great deal of intellectual curiosity, energy, and passion for the ACGME’s work.
  • Willingness to stretch into less familiar areas of the law.
  • Experience and familiarity with fundamental ERM principles and practices.
  • Proficiency in reviewing, drafting, and negotiating a variety of business contracts such as licensing, software, and service agreements.
  • Excellent writing, speaking, research, analytical, and organizational skills.
  • Attention to detail and ability to work independently and on multiple teams.
  • Excellent legal research skills.

Preferred:

  • Familiarity/experience with health care-related transactions.
  • Experience with HIPAA, copyright/trademark, association law, litigation, legislative/regulatory issues, and employment law.
  • Previous experience in accreditation, the medical education field, or an allied health field.

Equipment

Position requires the significant use of standard office equipment, such as a computer, keyboard, mouse, photo copier, fax machine, telephone, etc.

 

Working Conditions

Most of the work of the Senior Attorney and Manager of ERM is normally done in the ACGME office with the typical physical demands of an office environment. During the COVID-19 pandemic, ACGME employees are working remotely until further notice. The Senior Attorney and Manager of ERM will need to be able to efficiently and effectively work remotely.

While performing the duties of this job, the Senior Attorney and Manager of ERM:

  • Must be willing and able to attend at least three out of state meetings per year, running anywhere from three to five days per meeting, typically over weekends.
  • Will frequently be required to sit in meetings for long periods of time.
  • Will frequently be required to sit and work for extended periods of time at computer terminal using various computer programs and other computer tools.
